These Terms of Service (“Terms”) govern your use of our website, located at www.spora.co.za, and any related services provided by us including but not limited to Email, WhatApp and Social Media services.

1. Acceptance of Terms

By accessing or using our website, you agree to be bound by these Terms and all Terms incorporated by reference. If you do not agree to all Terms, refrain from the use of our website and related services.

2. Online Store Terms

  1. By placing an order through our website, you warrant that you are legally capable of entering into binding contracts.
  2. You agree to provide accurate, current, and complete purchase and account information for all purchases made at our store.
  3. We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address and/or phone number provided at the time the order was placed.

3. Payment

  1. All prices listed on the website are in South African Rand (ZAR) and are inclusive of VAT.
  2. We accept payments online using Visa and MasterCard credit/debit cards, Instant EFT, and other secure payment gateways.
  3. Payment processing will not begin until we receive all the information we need.
  4. All prices listed and/or quoted are final and not subject to negotiation unless stated otherwise.

4. Wholesale and Custom Orders

  1. All Wholesale and Custom Orders are subject to quotation and stock availability.
  2. Wholesale and Custom orders are excluded from all discounts, sales, vouchers and gift cards.
  3. Orders are placed exclusively to wholesale@spora.co.za, orders@spora.co.za, or via WhatsApp.
  4. Bank issued Proof-of-Payment must be emailed to orders@spora.co.za with your invoice or quotation number as reference. Failure to do so will result in order processing delay.
  5. Invoice and Quotations are valid for 72hours from time of issuance, unless stated otherwise on the issued invoice, failure to settle the Invoice during this time will result in stock availability not being guaranteed.
  6. All quotations with the marking “+” in connection to the quantity of a product has a price listed per kilogram unless specified otherwise.

5. Delivery

  1. We aim to deliver goods within the estimated time frames set out on our website. However, delays are occasionally inevitable due to unforeseen factors or events outside our control.
  2. Delivery will be to the address specified by you when placing your order.
  3. Risk to the goods passes to you upon courier handover. We advise the purchase of courier insurance which can be noted at the time of checkout. Should you request courier insurance, an additional invoice will be issued to you for the outstanding balance before order processing.
  4. Accurate and complete delivery information must be provided, this includes a delivery address, email address, cell number as well as your full name. Note that our courier requires this complete list of information to ship your product, failure to provide this information will result in a delay of processing and shipping your product.
  5. Any queries regarding delivery, packaging or damaged parcels must be directed to orders@spora.co.za with an order/invoice number referenced.
  6. Should you require your order shipped as soon as possible, please email orders@spora.co.za or wholesale@spora.co.za and request a rush fee of 10% to be applied. Rushed order requests are accepted at the teams discretion.

7. Privacy Policy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website and/or contact us through any channel.

8. Intellectual Property

All content on our website, including text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Spora or its content suppliers and protected by South African and International copyright laws.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Spora shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the website; (b) any conduct or content of any third party on the website; (c) unauthorized access, use, or alteration of your transmissions or content; or (d) the use of our products: or (e) any extended services.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa.

11. Changes to Terms

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the service following the posting of any changes to these Terms constitutes acceptance of those changes.
